These Terms of Service ("Terms") govern your access to and use of VibeSnapper (the "Service"), operated by AGILAYER ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
VibeSnapper is an AI-assisted product feedback tool. You upload or capture screenshots of in-progress web interfaces and we return written analysis, suggested improvements, and copy-paste prompts you can use with AI coding assistants. The Service may rely on third-party AI model providers to generate responses.
2. Eligibility and Accounts
You must be at least 13 years old (or the minimum age in your jurisdiction) to create an account. You are responsible for the security of your credentials and for all activity under your account. Notify us via the contact page if you suspect unauthorized access.
3. Plans, Billing, and Cancellation
- Paid plans (Builder, Studio) are billed monthly in advance via Stripe. Charges appear on your statement as AGILAYER.
- Subscriptions renew automatically until cancelled. You may cancel any time from the Account page or the Stripe billing portal; cancellation takes effect at the end of the current billing period.
- Except where required by law, fees are non-refundable. We may change prices with at least 30 days' notice; changes apply at your next renewal.
- When a paid subscription expires or is cancelled, your review history, screenshots, and custom knowledge base entries will be permanently deleted at period end. Your projects are retained.
4. Acceptable Use
You agree not to:
- Upload content that you do not have the right to share, that infringes third-party rights, or that contains personal data of others without a lawful basis.
- Submit screenshots that depict illegal content, sexual content involving minors, or content that promotes violence, harassment, or self-harm.
- Reverse engineer, scrape, or attempt to extract the underlying models, prompts, or system instructions of the Service.
- Use the Service to build a directly competing product, or to train a machine learning model.
- Abuse, overload, or interfere with the Service, including circumventing rate limits or quotas.
5. Your Content
You retain all rights in the screenshots, notes, prompts, and other materials you submit ("Your Content"). You grant AGILAYER a worldwide, non-exclusive, royalty-free licence to host, store, transmit, process, and display Your Content solely to operate, secure, and improve the Service for you. We do not use Your Content to train foundation models. Sub-processors (including AI providers) only receive Your Content to the extent required to fulfil your request.
6. AI-Generated Output
Output from the Service is generated by machine-learning models and may contain inaccuracies, omissions, or unsafe suggestions. You are responsible for reviewing output before relying on it, shipping it to production, or running any generated code. Output is provided "as is" and should be treated as a draft, not professional advice.
7. Knowledge Base
Studio plan customers may upload custom prompts, style notes, and reference materials ("Knowledge Base"). Your Knowledge Base is private to your account, retrieved only for your reviews, and never shared with other customers. The built-in expert knowledge base provided to all users is curated by AGILAYER and is not your content.
8. Confidentiality and Security
We use industry-standard safeguards (TLS in transit, encryption at rest, row-level security in our database) to protect Your Content. No system is perfectly secure; do not upload secrets, credentials, or regulated data (PHI, full payment cards, government IDs) to the Service.
9. Third-Party Services
The Service uses Supabase for hosting and storage, Stripe for payments, and one or more AI model providers for analysis. Your use of those services through VibeSnapper is also subject to their terms and privacy notices.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that output will be accurate or fit for your purpose.
11. Limitation of Liability
To the maximum extent permitted by law, AGILAYER will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability arising out of or related to the Service is limited to the greater of (a) the amounts you paid us in the twelve months before the event giving rise to the claim, or (b) USD $100.
12. Termination
You may close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your usage poses a risk to the Service or other customers. Upon termination, the data-deletion rules in Section 3 apply.
13. Changes
We may update these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which AGILAYER is established, without regard to conflict-of-laws rules. Disputes will be resolved exclusively in the courts of that jurisdiction, except where you have non-waivable consumer rights elsewhere.
